This privacy notice applies to Ella Software, LLC ("Ella," "we," "us," or "our") and describes how we collect, use, and protect information when you use our services, including ella.kids (our marketing site), ellakids.app (our platform), and any other domains we operate.

Ella is an AI-powered platform that helps professionals create visual supports for neurodivergent children. Users describe a child-safe avatar in words, and Ella generates that avatar for use across a range of visual support formats — social stories, visual schedules, picture cards, worksheets, games, strips, and more.
Ella is a professional platform. Our services are designed exclusively for adults. Students and minors do not have accounts on Ella and do not interact with our platform directly. Visual supports created on Ella are intended for offline use or supervised settings.

Ella does not collect student records, IEP data, academic performance data, student demographic information, or any data from a student's educational record. No student has a direct account or any direct interaction with our platform.

We do not sell your personal information. We share data only in the following circumstances.
Ella uses third-party service providers ("sub-processors") to deliver certain functions of the platform, including cloud hosting, AI content generation, and payment processing. All sub-processors are contractually bound to handle data only as necessary to perform their services, to comply with applicable privacy laws, and not to use any data for model training purposes. No personally identifiable information is transmitted to AI sub-processors. A current list of sub-processors is available upon request by emailing hello@ella.kids.
We may disclose information if required by law, court order, or government request, or when we believe disclosure is necessary to protect the safety of any person or to enforce our terms.
If Ella is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you before your information is transferred and becomes subject to a different privacy policy.
We use cookies and similar technologies to support account authentication, maintain session state, and collect usage analytics. You can configure your browser to refuse cookies, though some features of the platform may not function properly if you do.
We do not use cookies to serve targeted advertising.
Your account data is retained for as long as your account is active. If your account is inactive for more than two years, we will securely delete your data. You may also request deletion of your account and data at any time (see Section 9).
For data processed in connection with a school or district contract, we will return or securely delete data within 7 days of contract termination, or upon written request. We will provide written confirmation upon completion.
Backup copies of data are retained for a short operational period (currently 5 days) for disaster recovery purposes and are then automatically overwritten.

Ella conducts internal security reviews quarterly. Despite these measures, no system is completely immune to risk. We encourage you to use a strong, unique password and to access Ella only from secure environments.
Ella is designed solely for use by adults. Students do not have accounts on Ella, do not log in, and have no direct interaction with our platform. Any learning materials created are intended for offline or supervised use only.
We do not solicit or knowingly collect personal information from children under 13. If we learn that such information has been collected, we will delete it promptly. If you believe a child under 13 has provided us with personal information, please contact us at hello@ella.kids.
Ella is designed to support FERPA and COPPA compliance by limiting data collection to what is necessary for staff use only.
FERPA: Ella does not collect, store, or process student education records as defined by FERPA. The platform is used exclusively by school staff and authorized professionals. Any optional use of a child's first name or pseudonym in a visual support is entirely at the discretion of the staff member and is not transmitted to or retained by any AI sub-processor.
COPPA: Ella does not direct its services at children under 13 and does not knowingly collect personal information from children. The platform is for adult professional use only.
State laws (SOPPA, NY Ed Law §2-d, and similar): Where Ella enters into a data privacy agreement with a school or district, we operate in full compliance with applicable state student privacy laws. We are happy to review your district's data privacy agreement. Contact us at hello@ella.kids.

If you are a California resident, the California Consumer Privacy Act (CCPA) grants you specific rights, including the right to know what personal information we collect, the right to request deletion, and the right to opt out of the sale of personal information.
We do not sell personal information.
The categories of personal information we collect are described in Section 2. We collect identifiers (email address, name) and usage data. We do not collect sensitive personal information beyond what is necessary to operate your account.

If you are a Virginia resident, the Virginia Consumer Data Protection Act (CDPA) provides you rights including the right to access, correct, delete, and obtain a copy of your personal data, and the right to opt out of targeted advertising and profiling.
We do not sell personal data or use it for targeted advertising.

Ella's services are hosted in the United States. If you access Ella from outside the United States, please be aware that your information will be transferred to and processed in the US. By using our services, you consent to this transfer.
We may update this policy from time to time. The "Last updated" date at the top of this page reflects the most recent revision. If we make material changes, we will notify you by email or by posting a prominent notice on our website. We encourage you to review this policy periodically.
